O-1A Visa
Those with extraordinary abilities in sports, education, business, entrepreneurship, computer science, research, medical specialty, data science, business CEO, or science may qualify for an O-1A visa. This visa celebrates advanced talent across many fields, but the evidence required to demonstrate differs based on the area of experience you are in. Whether you bring groundbreaking discoveries or innovative ideas, it is important to understand the requirements for the O-1 visa in your field. With a clear understanding of the criteria for your profession, you can establish a stronger application that highlights your skills and accomplishments.
To apply for an O-1A visa, you must submit Form I-129. Let us help you with the instructions and confirm that all necessary documentation has been prepared properly. For timely processing, you should send in the form at least 45 days prior to the job. The petitioner will not be able to file Form I-129 more than six months before the intended start date. You must provide, along with your form, an advisory letter written by an organization of your peers. This could be a management organization or labor union, who can attest to your extraordinary ability in your field. Importantly, if the letter was written using stationary with a watermark identification, the petitioner has to send the original copy. Not showing the actual watermark could result in the process getting delayed, where the USCIS may send a request for evidence (RFE) to receive the original marked copy.
